Elevating Industrial Design: IPOPHL's Strategic Upgrades and Adoption of the Hague System

In a rapidly evolving world, the Intellectual Property Office of the Philippines’ (IPOPHL) Bureau of Patents (BOP) is innovatively enhancing its repertoire. The BOP is notably intensifying its efforts to expand its skills in examining both complex and emerging industrial designs (ID). This initiative is a testament to IPOPHL's commitment to growth and development in the face of technological advancements.


This year, BOP examiners participated in a two-day seminar focused on the “Substantive Examination of ID.” The seminar, conducted by the Japan Automobile Manufacturers Association (JAMA) and the Japan External Trade Organization (JETRO), provided invaluable insights into creating designs and determining when minute differences can suffice to prove novelty.


Japan, a nation known for its maturity in the design industry, proves to be an ideal partner for learning and growth. The shared knowledge of JAMA and JETRO is instrumental in equipping our examiners for local designers who are setting their sights on various foreign markets.



The advancement of BOP's expertise in ID is a timely initiative given the surge in ID applications. In 2023, ID applications grew a staggering 20% to 1,488 from 1,241 in 2022.


The recent seminars have also aided BOP in gleaning knowledge from the Japanese experience in optimizing the use of the Hague System. This knowledge is crucial for the country's ongoing work in acceding to the Geneva Act of the Hague Agreement.



The accession documents are currently with the Department of Foreign Affairs. The Philippines is expected to accede to the Hague within the year and for IPOPHL to operationalize this later this year or early 2025.



The BOP is not only enhancing examination skills but also upskilling its administrative staff. The goal is to ensure a streamlined process for applications under the Hague system. 



IPOPHL will also be coordinating with the World Intellectual Property Organization (WIPO) for greater IT support. This is important in managing the expected influx of online applications.



The simplified international filing system under the Hague Agreement will allow Filipino designers to protect their designs efficiently in multiple jurisdictions. Small and medium enterprises can also enjoy lower cost in filing fees compared with filing individually in each country.



With these strategic improvements, IPOPHL is paving the way for a future where Filipino designers can innovate without fear and protect their work effectively. The adoption of the Hague System is not just a step forward, but a leap into a world of endless possibilities.
